Destination Balloon Rides Terms of Service

PLEASE READ THESE TERMS CAREFULLY.

1. Acceptance of Terms

By booking, purchasing, or redeeming a hot-air balloon flight, or Package with Destination Balloon Rides, you (“Passenger”) agree to be legally bound by these Terms & Conditions. Do not proceed with your booking, purchase, or redemption until you have read, understood, and accepted all terms and conditions.

2. Definitions

Destination Balloon Rides: Refers to Destination Balloon Rides, its employees, affiliates, agents, and authorized contractors.
Service: Refers specifically to hot-air balloon flights and other experiences offered by Destination Balloon Rides, including accommodation and custom activities where arranged.
Service Operator: Refers to Destination Balloon Rides or any independent contractor delivering services to the Passenger under these Terms.
Individual Passenger Booking: A booking of 1 to 3 people on a scheduled flight.
Group Passenger Booking: A booking of 4 or more people on a scheduled flight.

3. Limitation of Liability

Destination Balloon Rides shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to lost property, lost profits, disappointment, or other intangible losses. Seattle Ballooning may subcontract flight services to third-party balloon operators and shall not be held liable for any loss, injury, or damage arising from subcontracted services.

Destination Balloon Rides reserves the right to alter flight routes, content, or locations where necessary and to provide equivalent services if changes are made.

4. Pricing and Payment

All prices are quoted in U.S. Dollars (USD) and are subject to change without notice. Prices do not include applicable credit card processing fees or other bank fees. Payment methods accepted include cash, check, money order, credit card (Visa, MasterCard, Amex, subject to a 4% surcharge for Amex), and direct deposit.

5. Booking Confirmation

Full payment is required to confirm bookings. Passenger names, estimated weights, and contact details may be required for manifest and flight scheduling.

6. Weather, Mechanical, Staffing & Safety Conditions

Hot-air balloon flights are weather-dependent and may be affected by mechanical or staffing issues. Destination Balloon Rides reserves the right to cancel, postpone, or modify flights or tethers up to the moment of launch if conditions are deemed unsuitable or unsafe. In such cases, payment may be held as credit for future flights (see Section 7).

7. Flight Alteration & Cancellation Policy

Our cancellation policy is designed to be as accommodating as possible:

Full Refund or Credit: Passengers will receive a full refund or credit if cancellation is requested at least 7 days prior to the scheduled flight date.
Operator Cancellations: If Destination Balloon Rides cancels the flight due to weather conditions or any other unforeseen circumstances, passengers are eligible for a full refund or credit.
Rescheduling: Passengers may reschedule their flight without penalty if the request is made at least 48 hours before the scheduled flight time.
No-Shows: Passengers who fail to show up for their scheduled flight without prior notice (a “no-show”) will not receive a refund or credit.
Tethers and Customized Events: The cancellation and alteration terms for tethers and customized events remain as previously outlined.

8. Passenger Responsibilities

Passengers must provide accurate information, including names, weights, and contact numbers, no later than 48 hours prior to the flight. Passengers are responsible for timely arrival at the designated meeting point. It is required that all passengers follow instructions from Destination Balloon Rides pilots and crew.

Passengers with medical conditions should consult with a healthcare provider before booking. Destination Balloon Rides shall not be liable for health-related incidents arising during or after the flight.

9. Entry Restrictions

Weight Requirements: Passenger weights are required for flight manifest purposes.
Age: Children ages 3–14 are permitted with an accompanying adult. Adult pricing applies from age 15.
Disabilities: Passengers must board and exit the balloon unassisted. No wheelchair facilities are available.
Pregnancy: Guests who are pregnant may not fly.
Diving: Passengers who have dived the day before the flight should consult a dive master regarding balloon flight risks.

10. Communications Consent

By completing your booking with Destination Balloon Rides, you consent to receive communications from Destination Balloon Rides via text message and phone call regarding your reservation and future ballooning activities or marketing. You may opt out of marketing communications at any time by following the instructions provided in the message or by contacting us directly.

11. Jurisdiction and Governing Law

These Terms shall be governed by the laws of the State of Washington. In jurisdictions where liability limitations are not permitted, Destination Balloon Rides liability shall be limited to the maximum extent allowable by law.

12. Amendments to Terms

Destination Balloon Rides reserves the right to amend these Terms & Conditions without notice. Continued use of Destination Balloon Ride’s services after changes are posted constitutes acceptance of the updated Terms.

13. Intellectual Property

All content on Destination Balloon Rides website and marketing materials is the intellectual property of Destination Balloon Rides and may not be copied, distributed, or modified without written consent.
